border-box;">《民法典》正式出台，意味着我国民事权利保护将进入法典时代。</strong></span>这是中国特色社会主义进入新时代，依法治国进程中的标志性大事件。《民法典》是社会主义市场经济的基本法律，将对国家的治理方式产生重要影响。由于中国采用的是大陆法系，行政法与民法的适应范围是不同的。对于行政规范，《民法典》只定了原则，留了接口，没有具体的规定。这就需要规范不动产使用的《城乡规划法》《土地管理法》等行政法规，尽快回应《民法典》中的权利关切，完善相关的法律规范，将《民法典》中的物权规则具体化。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"  /></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">在社会主义市场经济背景下，国土空间规划的法律属性逐步彰显。这不仅表现在规划许可、违法查处中，而且表现在规划的制定方面。从《民法典》的角度，随意制定和调整城市规划就是对物权的不尊重。目前，中共中央国务院已经部署了“推进土地要素市场化配置”改革。促进市场机制在配置土地要素过程中有效、有序与公平的运行，国土空间规划必须面对土地发展权、相邻关系、地役权、土地征收权等概念，并建立与完善相应的法规体系、政策体系。这是“更好发挥政府的作用”的逻辑关系和应有之意。</p><p border-box;">相邻关系是《民法典》中的一个基本概念，也是国土空间规划体系中的一个十分重要的概念，无论是在规划编制还是规划许可过程中都要面对这一问题。</strong></span>相邻关系十分复杂，不仅涉及静态的相邻关系，而且相邻关系处于一种变化之中。如果规划编制与规划许可不重视相邻关系，也会引起社会矛盾。例如，由若干块用地组成的居住区，过去规划曾经是工业用地，在审批了几块工业用地以后，规划变更为居住用地。剩下的用地如何审批？如果继续按工业用地审批，虽然可形成良好的相邻关系，则结果是不是依规划许可，属于违法审批？如果按居住用地审批，虽然是依法审批，则结果是不符合规划原理，形成工业用地与住宅用地混杂的情形。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">类似的问题在用途管制中经常碰到，但是，在国土空间规划领域对相邻关系的讨论却很少，似乎这是一个被遗忘的理论概念。<span style="color: rgb(139, 0, 0);box-sizing: border-box;"><strong style="box-sizing: border-box;">建立与《民法典》相衔接的行政规范，需要从公法范式系统地对物权规则进行理论研究，需要学界的共同努力。</strong></span>我一直在思考如何写一篇对相邻关系进行探讨的文章，总找不到切入点。在读到法学中日渐式微的先占原则后，对这一问题更加疑惑了。直到读到科斯定理，似乎才对这一问题有所理解。于是乎，忘乎所以、匆忙上阵。文章中的问题在我，供学界批评。在成文后，承蒙《城市规划》刊出，在此致谢。</p></section></section></section><section border-box;">用途管制本质上是对土地发展权配置，对相邻关系的规范以及对空间利益平衡的过程。相邻关系是一项在用途管制中界定、保护与激励土地使用的重要制度，也是改善人居环境的基本制度。相邻关系是民法中的概念，以规划为依据的用途管制改变了相邻关系的界定方式与表现形态，其界定由民法范式转向了公法范式。用途管制采用的是整体主义的方法论以及事前干预的方式重新界定了相邻关系。规划并没有完全界定相邻关系，所留在公共领域的部分则是按照排队原理进行配置。由于交易成本的存在，土地使用效率的提升需要基于公平的相邻关系的制度设计。在相邻关系的界定中，以公法规范为主体的用途管制并不排除民法规范和公序良俗的运用。</span><br border-box;">中共中央国务院发布的《关于建立国土空间规划体系并监督实施的若干意见》，提出“形成以国土空间规划为基础，以统一用途管制为手段的国土空间开发保护制度”，正式确定了国土空间用途管制的制度框架，也预示用途管制运行模式与机制发生了重大转型。社会主义市场经济的基础是产权明晰与产权保护的现代产权制度。以2007年颁布的《物权法》为标志，现代产权制度逐步建立。但是，由于体制的分割，目前尚未形成一套基于现代产权制度的用途管制体系。用途管制是公权力对物权的激励与制约，而土地相邻关系则在用途管制中发挥着重要作用。在用途管制中，无论土地如何使用，都会对周边的土地使用产生正面或者是负面的影响，形成社会极为关注的相邻关系。<span border-box;">(1)简便。</strong>先占具有很好的识别性，通过“先占”的辨识很容易确定产权主体。<strong style="box-sizing: border-box;">(2)效率。</strong>先占者一般对所占资源的财产识别度相对较高，这符合财产法中的将产权赋予使用效率较高的主体的基本原则。先占原则在财产法中如此重要，美国学者理查德·爱泼斯坦(Richard border-box;">由于城镇、乡村的空间变迁是由小到大，城乡中任何一块土地的使用都具有相互影响与先后关系的特征。无论是日照影响，还是邻避效应，都涉及先后顺序的相邻关系，而先后顺序成为了财产纠纷的重要因素。先后关系引发的相邻土地相互影响的效果是不一样的。在H市的一个案例中，现状两块相邻的土地，其中一块是油库、另一块为空地。而在控制性详细规划中，两块用地均为住宅用地。按照现状，油库的相邻关系符合法律规范。如果依据控制性详细规划，油库尚未搬迁，另一块空地就不能按住宅用地审批。否则，就会产生巨大的矛盾。油库为“先占”，而住宅为后来者。由于油库是“先占”，油库周边为安全防护用地，不允许建设住宅。只有先搬迁油库，才能依据规划形成良好的相邻关系。为此，<span Komesar)[12]在《法律的限度》中描述的纽约州法院受理的新区流动人口诉大西洋水泥厂案，采用的是利益衡量方式或者是资源使用效率最大化的方式，要求水泥厂给原告支付经济补偿。由于该案所涉及的是7位居民，如果涉及人数增加，则利益的对比可能发生转化。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">科斯方式将外在影响相对化，谋求了最大的社会利益，也导致了权利的冲突。在解决权利冲突中，科斯的假定是交易成本为零或者是很小，但现实交易成本很大。这种提升资源配置的效率，也就是社会财富最大化的原则，并不符合生命、健康权的保护，以及公平、正义原则。在城乡中任何一块土地的使用所影响的，不是一对一的关系，而是一对多的关系。例如，在城市中建设一栋高层建筑，其日照影响并不只是前后地块，甚至影响到并不相连临的地块。这种影响不止涉及个体的利益，在一定程度上则转化为公共利益。如果是影响到公共利益，所涉及的社会成本就会很大，甚至引起社会冲突。权利赋予先占者是最简单的赋权方式。这对珍惜土地、保护土地的财产权具有积极的意义，但过度保护土地的财产权利则不利于土地使用效率的进一步发挥。因此，权利的扩张或者限制应有明确的边界。</p><p border-box;">用途管制是依据国土空间规划，但是，从法律关系上看，国土空间规划是一种不成熟的行为。被国土空间规划覆盖的不动产一直可以使用并获得利益，直到新的用途产生。在行政法学中，成熟是指行政行为所产生出的法律效果，足以让司法介入的状态。这是指行政行为尚未产生法律后果。国土空间规划是未来导向的管制规则，并不针对现状的物权的用途。<span style="color: rgb(139, 0, 0);box-sizing: border-box;"><strong style="box-sizing: border-box;">在国土空间规划体系下，用途的改变必须是法律赋权或者是规划许可的结果。</strong></span>法律赋权或者是规划许可，不仅对所管制的地块的用途、开发强度进行控制，还会对周边地块发生影响，甚至产生法律关系。这就是成熟行为。然而，在国土空间规划中，相邻关系并没有完全界定，仍有一部分留在公共领域。有必要在规划许可过程中，通过环境影响、日照影响、交通影响、安全影响等评价，根据相关标准进一步细化并精确界定相邻关系。</p><p border-box;">相邻关系是相互的，自己的权利就是相邻权利人的义务。它既是要求相邻的对方提供实现权利的便利条件，也是相邻的对方在实现权利时接受对方对自己的限制。《物权法》第84条规定“不动产的相邻权利人应当按照有利生产、方便生活、团结互助、公平合理的原则，正确处理相邻关系”。从《物权法》相邻关系的表述中，可以得出相邻关系规范基础是道德范式，要求“团结互助、公平合理”。在第85条中则明确指出，“法律、法规对处理相邻关系有规定的，依照其规定；法律、法规没有规定的，可以按照当地习惯”。这就是说相邻关系的建立可以基于法律的规范或者依据公序良俗的约定，也就是相邻关系的处理有两种方式，法律规范与道德规范。从另一角度看就是存在正式制度与非正式制度。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"  /></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">所谓的法律规范实际上就是正式制度，是国家权力机关通过的必须遵守的行为规范。正式制度所规定的是“最低标准”，而道德规范则是在社会发展过程中形成的行为规范。与陌生人社会不同的是熟人社会，更多的是一种无规则的“公众控制”。在熟人社会的乡村，村规民约、道德规范在相邻关系处理中发挥了主导作用。例如，广为人知的是安徽“六尺巷”的形成，道德发挥了重要作用。“小社区里邻里关系稳定，以非正式的社会道德规范机制来解决财产上的争端，这里没有法律的影子”[12]。在美国的休斯敦采用征求邻里意见的方式来作为许可的依据，可以看作是采用一种非正式的制度。在中国的老旧小区改造、加装电梯、以及一些城市私房翻建的规划许可中采用征求邻居的意见可作为许可的重要依据。最近，在自然资源部的农村宅基地的审批中，征求邻居的意见也是一个重要的前提。这反映出非正式制度仍在相邻关系的建构中发挥重要作用。</p><p border-box;">虽然，先占原则在财产关系中的作用日渐式微，但是，由于交易成本的存在，“先占”原则仍然发挥着重要作用。国土空间规划是依据人们的意图对未来空间发展的谋划与行动准则的制定。依据国土空间规划的用途管制并不是未来导向的行为，而是将未来的发展目标转化为现实的行为。在用途管制中，权利关系是基于现状，权利关系人所指的是现状权利关系人，而不是未来的权利关系。在厦门的PX项目事件中，由周边相邻的住宅区块与PX项目构成的相邻关系的现实性，导致了土地用途的冲突。在杭州钱江新城热电厂的处置中，为了营造未来的良好相邻关系，通过行政补偿的方式中止了已经生效的规划许可。用途管制中相邻关系的现实性必然影响到用途管制中的行政行为。因此，用途管制是基于现实的行为。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"  /></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">“相邻关系的产生情形十分复杂，相邻关系的调整既涉及相邻业主之间的利益，也可能与公共利益有关”[16]。<strong style="box-sizing: border-box;">相邻关系的现实性，产生如下影响：</strong></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"  /></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">(1)基于现实的规划许可。</strong>建设项目的规划许可所考量的相邻关系是基于现状，还是基于未来规划，这是最容易忽视的。由于先占原则的存在，无论规划如何制定，均应考量规划许可用地周边的土地使用现状。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"  /></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">(2)基于排队原理的城镇生长。</strong>任何项目的嵌入都依赖于现实的相邻关系。一旦一个新的建设项目嵌入，就会与周边地块的不动产构成新的相邻关系。城镇的“生长”是基于这种相邻关系的变迁而不断生长，也就是按照排队原理在“生长”。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">(3)预测的难度加大。</strong>相邻权的引入也影响到详细规划的制定。建设项目的嵌入过程是相邻关系的改变过程，而建设项目的实施既有按规划实施的，也有修改规划后实施的。修改的数量越多，就越会造成事前预设的相邻关系的变化越多，增加对未来预测的难度。</p><p style="white-space: normal;margin: 0px;padding: border-box;">早在2016年中共中央国务院在“关于完善产权保护制度依法保护产权的意见”就提出，“建立健全归属清晰、责权明确、监督有效的自然资产产权制度，完善自然资源有偿使用制度”。土地使用的基本特征是相互联系、相互影响，相邻关系在提升土地使用效率、平衡空间利益、改善人居环境扮演了重要角色。“法律的运行、资源的配置的进化过程就是以交易成本为最低原则，不断地重新权利配置、调整权利结构和变革实施程序的过程”[3]。用途管制的介入，无论是界定相邻关系的方法论，还是相邻关系的表现方式都发生了重大变化。相邻关系不仅是相邻不动产一一对应的关系，更多是“一对多”的情形。以规划为依据的用途管制采用的是整体主义的方法论和事前干预的方介入相邻关系建构的全过程。相邻关系确定的基本原则是在尊重“先占”的前提下提升土地的使用效率。基于公法范式的相邻关系制度，并不排斥民法规则以及公序良俗的运用。我国首部《民法典》即将在2020年召开的十三届全国人大三次会议审议，迫切要求完善与《民法典》中物权规则相衔接的用途管制制度。<span
